- Introduction
- Welcome to ROD SOCIETY, a platform for finding fishing guides in selected locations. By using our website and/or booking our advertised expeditions, you agree to comply with and be bound by the following terms and conditions.
- Services Offered
- We, ROD SOCIETY, managed by Andrea Eugenio Ramella, P.IVA: 13604120967, are responsible for the operation of the ROD SOCIETY platform. Our platform is available worldwide in various languages and is designed to be fast and easy to use.
- We manage the ROD SOCIETY platform as an intermediary platform where guided tours and tourist activities (collectively "Activities") are offered online by various local activity providers, such as fishing guides, fishing lodges and BnBs around the world ("Providers"). Activities include guided tours, fishing expeditions, fishing courses, fishing days, etc… The fishing guides (Providers) with whom Rod Society works have entered into a mandate agreement with Andrea Eugenio Ramella to manage bookings and customer relations. This means Rod Society acts as the commercial representative of the guides and is responsible for organizing and facilitating the contract between the user and the guide.
- Responsibility
- The client acknowledges that ROD SOCIETY has no responsibility for the excursions. The fishing guides declare that they have all the legal and fiscal permits to operate in their respective locations.
- The fishing guides (Providers) are solely responsible for the safety and well-being of participants during activities. Rod Society does not take any responsibility for accidents, injuries, theft, or other incidents that may arise during the fishing experience. Guides indemnify Rod Society from any claims or liabilities that may arise from the guide’s actions.
- Activities and Contracts
- Our activities are visible on the ROD SOCIETY platform. The contract for the provision of the activity is concluded exclusively and directly between the user and the provider ("service contract"). By purchasing an activity on the ROD SOCIETY platform, the user buys directly from the provider, not from us.
- Performance agreements are concluded by us in the name and on behalf of the providers. We act as commercial representatives for the providers and are authorized by the providers to conclude transactions directly between the providers and users, such as the user in question, and on behalf of the providers to collect payments from users.
- Rod Society collects payments from users and retains a commission for its services. The remaining amount is paid to the guide after the fishing experience has been completed. The guide agrees to provide services at the price specified and is responsible for issuing invoices to users.
- We do not offer any activities ourselves and therefore do not become a contractual partner in the service contracts. We do not act as organizers, lessors, sellers, or other contractual partners in relation to the service contract with the user.
- Limitation of Liability
- ROD SOCIETY will not be liable for any indirect, incidental, or consequential damages arising from the use of the platform.
- Rod Society is not liable for any damages or incidents arising from the services provided by the guide, including accidents, injuries, theft, or property loss. The guides and clients are responsible for their actions and indemnify Rod Society from any claims or legal actions resulting from their conduct.
- Commercial Agent Responsibilities
- As the provider's commercial agent, we are the user's point of contact regarding a performance agreement and its payment. If the user wishes to request a refund of the booking price outside of our cancellation conditions, they may contact us. We will liaise with the provider, who will decide at their discretion whether to grant the refund request. The provider may manage any granted refund through us.
- Execution of Activity
